This Privacy Policy covers your use of FILTER (hereinafter ‘App’; owned by Filter Inc.) (also referred to herein as “us”, “we”) and describes how Filter will collect, process, store, and share your personal data, including with whom it is shared and your ability to opt out of limited aspects of Filter’s sharing and use of your personal data.
By downloading and using Filter’s App and any related products or services, you consent to our collecting, processing, storing, and sharing your personal data as outlined in this Privacy Policy. We will not share your information except as described herein.
IF YOU DO NOT AGREE WITH FILTER’S COLLECTING, PROCESSING, STORING, AND SHARING YOUR PERSONAL DATA AS OUTLINED BELOW, THEN DO NOT DOWNLOAD, ACCESS, OR USE FILTER, ITS APP OR IT’S RELATED PRODUCTS AND SERVICES.
IN ADDITION, THIS APP IS NOT INTENDED FOR NOR DIRECTED AT EUROPEAN RESIDENTS. AS SUCH EUROPEAN RESIDENTS ARE NOT PERMITTED TO USE THE APP. THIS APP IS INTENDED FOR AND MARKETED DIRECTLY TO RESIDENTS OF THE UNITED STATES.
In this Policy we define ‘personal data’ as it is defined in the 2018 General Data Protection Regulation (GDPR) implemented by the European Union (EU), including any information which alone or in combination with other information that we possess about you would identify you individually, including but not limited to information such as your name, postal address, email address, and telephone number.
WHY WE COLLECT, STORE, PROCESS, AND SHARE YOUR DATA
We require use of your personal data for the following purposes. By using the App and its related products, you explicitly consent to each of these purposes for collection, storing, processing, and sharing your personal information:
- Matching Service—We use your personal data to provide matching and other connection-related services with other users of the App and any related products, as part of the services that you are seeking by downloading our App and entering into this contractual relationship.
- Customer service requests—We need access to your data to respond to your service requests.
- Communicate with user about promotions, offers, updates, fixes, and information related to the App and related products. We use your data to suggest services, promotions, and opportunities that we believe would be of interest to you.
- Analyze usage of the App—We continually seek to improve performance and user benefit from the App and any related products.
- Investigate, prevent dangerous, illegal, fraudulent, harassing activities—We use user personal data to ensure the app is used properly.
- Illegal Activity—We may be required to provide information in a legal proceeding.
- Business Transfers—We may transfer your data if in the event of new ownership or bankruptcy.
INFO WE COLLECT and HOW WE USE IT
Upon setting up an account, we collect the following data that you provide and store it automatically: your email address, name, occupation, college or university, and profile picture(s). You are prompted to establish profile(s) based on your preferred and/or intended use(s) of the App as a matching service, including a) Serious Dating Relationship, b) Somewhat Serious Dating Relationship, c) Not Serious, and d) Just Friendship. Choosing one or multiple profiles will determine what type of information we will ask you to provide. You are also prompted to enter your, preferences and other personal information depending on the type of relationship you are seeking, which you voluntarily provide to us and which we also automatically store.
Within each profile, you voluntarily provide your preferences in regards to many factors and topics related to the type of people that you want to connect with including but not limited to: gender, religious belief, orientation, ethnicity, children, political affiliation(s)/belief(s), drinking, smoking, medicinal marijuana and other legal substances, hobbies, activities, music, food, sports, entertainment, and other preferences and interests, which we collect and store to aid in matching and connecting you with other users of the App and in providing you with additional information and suggestions, including events and activities related to the information and preferences that you provide us. Filter may add additional preference options in the future.
We also give you the option to create your Filter account using your Facebook account login. If you elect to create an account using this method, we will automatically store your login information and may also use personal data in your Facebook profile including but not limited to your friends and other information contained in your Facebook profile, including your name, date of birth, education, current and past, likes, who or what you are following, employment status, work history, pictures, and other information about yourself. Such personal data will aid us in providing you with matches, connections, and other helpful information and services on the App and related products. We do not utilize automated decision-making based on a solely-algorithmic basis.
We also request that you verify your identity by logging into your LinkedIn account or by entering your phone number and receiving a code via text message which you then enter into the app. We automatically store this information for verification purposes.
We also may collect and store information related to your use of the App and related products to help ensure optimal performance of the App and related products and to analyze such data for trends in usage. Such personal data includes but is not limited to log data such as a user’s IP address(es), browser, operating system, any referring domain, pages visited, duration of access, search terms, mobile carrier, unique mobile device ID, MAC address, device model, as well as other device specifications.
Further, to assist in providing matches, connections, and other helpful information and services on the App and related products, including but not limited to localized events, restaurants, or other relevant venues, we may track your geographic location. Such information is especially helpful in connecting you to local events and venues. We may share this geo-location data with third party applications that aggregate and provide information about events, as well as restaurants and venues in specific geographic locations.
In the event, that we offer services or products that require payment, we may collect and store your billing information, which we will store and process according to rigorous industry standards.
In addition, if you contact our Customer Service, we may collect and retain information about you and your use of the App in order to assist you with any questions, concerns, or technical difficulties, or otherwise, and to better serve you and your use of our App and related products in the future. We may keep records of our communications, including any info that you voluntarily provide to us, as well as any contact info you provide (e.g. email address, phone number, mailing address), and your IP address.
WHO WE SHARE INFORMATION WITH
We may share your information with other App users—for matching & connecting and with employees, affiliates, subsidiaries, and related entities for the effective functioning and improvement of the App and related products. We also may provide your personal information as provided by your use of the App and related products to third party service providers who support the operations of the App and related products (i.e. analytics, infrastructure, security). We enter agreements with these third party service providers to ensure that such service providers abide by all appropriate privacy laws and regulations and other legal and industry standards.
We may also disclose your personal information provided by your use of the App and related services and products for legal reasons including to respond to a court order or subpoena, to defend ourselves against claims or to assert claims on our behalf. We may disclose such information in regard to activity that we perceive, in our sole reasonable discretion, to be related to illegal, dangerous, and/or harassing activity. We also may disclose personal information of users as part of a merger, sale, acquisition, consolidation, divestiture, sale of assets, restructuring, bankruptcy, dissolution, liquidation, or other change of control or ownership.
OPT-OUTS
You may opt out of our use of your location information from your device (or geolocation services), although doing so will limit the benefits of App and related products and remove our ability to connect you with individuals based on location and limit our ability to suggest nearby events that we believe would be of interest to you.
LINKS TO THIRD PARTY SITES
Our App and related products may contain links to third party site(s) or app(s). If you click on a link to these third-party site(s) or app(s), you will be directed to that site. We cannot guarantee and do not endorse any third party or their site(s) or app(s) or any of their goods or services, neither are we representing that we are in partnership with these any of these parties. Further these sites are not covered by this Privacy Policy. As such we cannot accept liability for their violation of any of the privacy rights of any user and related parties. We strongly encourage you to read and be familiar with the privacy policies of any third-party app(s) or site(s) connected or linked to the App or any of its related products.
EMAIL AND TEXT COMMUNICATION
We will use your email address, which you are required to provide in order to create a Filter account to send you emails for business as well as promotional purposes. We may also communicate with you for the same purposes via text message on your mobile phone and via other similar messaging apps, services, and methods. By providing us with your cell phone number you expressly consent to receiving messages from us via SMS or similar technology, including for the purpose of promoting our products and services. If you do not wish to be contacted via SMS or similar messaging technology, you opt out by contacting us directly.
WARNINGS ABOUT POSTINGS
Be careful about what you post to your account(s) in the App and/or any related product(s) and service(s). Some of your information, including but not limited to your photo and first name, occupation, and college, age, height, distance away, what you have in common with a match, will be publicly visible on your profile page. Once a match (or connection) is made, additional information and media that you have submitted about yourself will be visible to that individual. Upon matching (or connection), your match’s (or connection’s) access to your extended profile will permit them to further share your information or media with their friends or other third parties privately or publicly via the internet or otherwise. AS SUCH, WE URGE USERS TO EXERCISE DISCRETION AND CAUTION IN WHAT CONTENT THEY POST TO THEIR PROFILE AS WELL AS WHEN DISCLOSING PERSONAL INFORMATION AND/OR MEDIA DIRECTLY TO OTHER USERS OF THE APP AND RELATED PRODUCTS. We do not recommend sharing email addresses, websites, phone numbers, residence or work addresses, or other means of direct communication with individuals until you have built sufficient rapport and trust with these individuals. Also do not provide financial details, government ID (e.g. drivers license, passport) information, or other sensitive information until such trust is established. Any sensitive information that you post about yourself, friend(s), loved one(s), or other individual(s) is at your own risk and potentially the risk of others and could readily become public information via search engine or otherwise. FILTER DOES NOT PROVIDE ANY PROTECTION OR GUARANTEE OF PRIVACY OF PERSONAL OR SENSITIVE INFORMATION.
PLEASE NOTE. We do not screen users of the App and related products nor do we perform background checks and are therefore unaware of their present, past, or likely future nature, behavior, or conduct and thus are not responsible for their behavior or actions. We do not actively police or review content or behavior of users. If, however, we become aware of dangerous or inappropriate conduct, by receiving notice of such conduct we will take action to limit the accounts of such individuals, while appropriate investigations and/or legal proceedings take place.
PLEASE EXERCISE CAUTION IN YOUR SHARING OF INFORMATION WITH OTHER USERS OF THE APP AND RELATED PRODUCTS.
STORAGE OF INFO, PRIVACY LAWS
We may store your information on servers located in various places, including servers located in the United States, as well as other locations around the world. Such locations are subject to change without notice to you or any other user. We reserve the right to move such information and servers wherever we decide in our sole discretion. Please note that data protection laws may vary from country to country. Data protection laws in the United States currently are considered by many industry organizations and leaders to provide less privacy protection that European data protection laws. AS MENTIONED ABOVE, THIS APP IS NOT INTENDED FOR NOR DIRECTED AT EUROPEAN RESIDENTS. AS SUCH EUROPEAN RESIDENTS ARE NOT PERMITTED TO USE THE APP. THIS APP IS INTENDED FOR AND MARKETED DIRECTLY TO RESIDENTS OF THE UNITED STATES.
SECURITY, WAIVER
Filter takes the security of your personal information and user data seriously. We use commercially reasonable, industry standard security measures to protect such information and data, including applying technical and administrative measures to protect against unauthorized access, destruction, or alteration as well as accidental loss. However, no internet transmission or network is ever 100% secure. As such, we cannot guarantee that user information will never be accessed in an unauthorized manner. Therefore, we must expressly disclaim any warranties or representations, express or implied, regarding any breaches of security, damage to your device(s), loss(es), or unauthorized use of your personal information or data provided directly to us or to any related parties or third-party service providers while using this app or any related services or products.
ACCOUNT DELETION; UNINSTALLING APP
You may uninstall your App at any time but uninstalling the App does not delete your account or remove your information from the App and its related products. To delete your account, you must go into the setting menu on the App. We will act quickly to remove your information, but please note that once you have deleted your account, it may take up to 30 days for all of your information and its alias to cycle out of our servers. We also reserve the right to maintain information on users who violated our terms of use and/or behaved in an inappropriate and/or harassing manner while using the App and its related products. We may also maintain information on users who are subject to existing or pending legal proceedings or investigations or likely legal proceedings or investigations, in our sole discretion, or are subject to internal Filter-initiated investigations. In addition, we may retain anonymous information in order to continue to improve and maintain the services provided by the App and its related products.
CHANGES TO THIS PRIVACY POLICY
We reserve the right to make changes to this Privacy Policy at any time. We will notify users of such changes by posting them on our App. You acknowledge that you will review such changes and accept such postings as notice to you of changes to this Privacy Policy. Your continued use of the service after the posting of such changes constitutes your acceptance of these changes to the Privacy Policy.
CALIFORNIA USERS
If you are a resident of California, you have the right to know if we share your personal data with any third parties for their third party direct marketing purposes (Civil Code Section 1798.83). You may contact us as outlined in the Contact Us section below to obtain this information.
In addition, as we do not operate a website, we do not have a policy regarding ‘do not track’ or similar signals sent from users’ computers.
Further, we do not knowingly permit third parties to collect personal information about our users’ online activities across other apps or online services when using or logged into the App.
